“We Are in a Situation of Constitutional Breakdown,” Says Enex Jean-Charles

Law professor Enex Jean-Charles, president of the Steering Committee of the National Conference that drafted the preliminary version of the new Constitution, declared that the country is operating outside the legal framework defined by the 1987 Constitution. The statements made by the former Prime Minister on Magik9, Thursday, September 4, 2025, come at a time when voices are being raised to denounce irregularities surrounding the constitutional revision process.

The members of the Transitional Presidential Council, the body that created the Steering Committee, took an oath and swore to respect and enforce the 1987 Constitution, in accordance with the provisions of the April 3 Agreement. Yet, the process of drafting the preliminary version of the new Constitution does not follow the lines laid down by the mother law of the Republic.

In this regard, former Prime Minister Enex Jean-Charles was asked if this amounted to a blatant violation of the 1987 Constitution. The law professor was clear:
