Michèle Oriol Denounces Flawed Property Clauses in Constitutional Draft

While speaking on Panel Magik on Monday, June 9, 2025, on Magik 9 radio, Michèle Oriol, former Executive Secretary of the Interministerial Committee on Territorial Planning (CIAT), expressed strong criticism of the draft for the new Constitution. According to the sociologist, the proposed text fails to consider both Haiti’s historical realities and its structural urgencies. She condemned an improvised and disconnected approach, accusing the Steering Committee of the National Conference of acting frivolously at a time when the country needs seriousness and vision.

At the core of her critique is the issue of land ownership. Michèle Oriol described the way this topic is handled in the draft as "irresponsible." She argued that the right of first refusal mentioned in the document has no place in a constitutional text but should instead be governed by specific urban planning laws, particularly within the framework of land readjustment. According to the sociologist, this provision reveals a lack of understanding of land mechanisms and risks creating confusion and conflict.
