Proposed Constitution Abolishes Communal Sections

In the current amended Constitution, the communal section is the smallest unit of the national territory. The draft of the new Constitution, presented on Wednesday by the Steering Committee, eliminates communal sections and establishes the commune as the smallest territorial division. It also eliminates the three-member municipal council and proposes a single mayor per commune with a five-year term.

In the draft of the new Constitution, the commune becomes the smallest administrative territorial entity of the Republic. According to Article 66 of the document, it has administrative and financial autonomy. It is a legal entity. Its method of administration and functioning is governed by law.

Article 66-1 of the draft Constitution proposes that each commune in the Republic be administered by a mayor elected by universal suffrage for a five-year term, with no limit on the number of times they may be re-elected.
