Marthel Jean Claude Applauds New Penal and Procedural Codes as Modern

On June 25, 2025, the Haitian Council of Ministers adopted, in just 25 minutes, the new Penal Code and the new Code of Criminal Procedure. These two legal frameworks replace the previous code, which dated back to 1835. While this adoption was welcomed by the Professional Association of Magistrates (APM), it also raises questions regarding its implementation and the public’s understanding of the new laws.

Invited to Panel Magik on Thursday, July 3, APM president Judge Marthel Jean Claude spoke about the progress made in these texts. He emphasized that this reform did not start from scratch. “It was not a new effort, but rather a reassessment of the issues raised in the initial version published under the presidency of Jovenel Moïse,” he explained.
